The Owner wants to renovate the existing Multi-Unit Residential (MUR) building and bring the property and building footprint into conformity with the requirements of the current Zoning By-law. 

The application indicates that the variances requested address conditions that existed prior to any of the Zoning By-laws with the exception of the new amenity area. As shown on plans filed with the Committee, the renovations will include:

  • Splitting each existing two-bedroom unit into one-bedroom units, providing six one-bedroom units in total;
  • Improving the interior condition of the apartments; and 
  • Demolishing the existing garage and storage structure at the rear of the building in order to provide an amenity area for the residents.

Relief Required

In order to proceed, the Owner required the Authority of the Committee for Minor Variances from the Zoning By-law as follows:

  1. To permit a reduced lot width of 10.18 metres, whereas the By-law requires a minimum lot width of 15 metres for a low-rise apartment building.
  2. To permit a reduced lot area of 308 square metres for a low rise apartment building.
  3. To permit a reduced easterly interior side yard setback of 0.29 metres for the 21 metres back from the street lot line, whereas the By-law requires a minimum setback of 1.5 metres for the first 21 metres back from the street lot line.
  4. To permit a reduced easterly side yard setback of 2.9 metres after the first 21 metres back fro the street lot line, whereas the By-law requires a minimum side yard setback of 6.0 metres after the first 21 metres in from the street lot line.
  5. To permit a reduced rear yard setback of 8.65 metres, or 28.6% of the lot depth whereas the By-law requires a minimum rear yard setback of 30% of the lot depth, in this case 9.07 metres.
  6. To permit steps to projects to 0 metres of the front lot line, whereas the By-law permits steps to project 1.5 metres into a required yard but no closer than 0.6 metres to a lot line.
  7. To permit a reduced amenity area of 13.5 square metres per dwelling unit or a total of 81 square metres, whereas the By-law requires a minimum amenity area of 15 square metres per dwelling unit, in this case a total of 90 square metres.
  8. To permit a reduced easterly side yard setback of 0.5 metres, for the portion of the building beyond 21 metres from the front lot line, whereas the Zoning By-law required a setback of 6 metres.
  9. To permit a chimney to project to 0 metres of a lot line, whereas the Zoning By-law requires a chimney, chimney box, or fireplace box to be no closer than 0.6 metres to a lot line.
